Terms of Service

1. Acceptance of Terms

By accessing or using the AIPixer Seller Hub platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and AIPixer ("we," "us," or "our").

2. Description of Service

AIPixer Seller Hub is an AI-powered toolkit designed for Indian ecommerce sellers. The Service provides tools including but not limited to:

• PDF label cropping and auto-detection
• Marketplace image resizing (Amazon, Flipkart, Meesho)
• Image optimization and background removal
• AI-powered product listing generation
• A+ content storyboard generation
• Meesho shipping cost estimation

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Payment

4.1 Credit System

The Service operates on a credit-based system. Each tool consumes a specified number of credits per use. Credits are purchased in packs and are non-transferable between accounts.

4.2 Pricing

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change pricing at any time. Price changes will not affect credits already purchased.

4.3 Refunds

Due to the digital nature of the Service, refunds are generally not provided once credits have been consumed. If you experience a technical issue that prevents a tool from functioning as intended, contact us at contact@aipixer.com and we will review your case. Unused credit packs may be eligible for a refund within 7 days of purchase, at our discretion.

4.4 Free Credits

Free users receive 50 credits per month, credited in daily increments of approximately 2 credits. Unused credits expire at the end of each month and do not accumulate. Credit amounts may be adjusted at our discretion with 30 days notice.

5. User Content

5.1 Ownership

You retain full ownership of any images, PDFs, product data, or other content you upload to the Service ("User Content"). We do not claim any ownership rights over your User Content.

5.2 License Grant

By uploading User Content, you grant us a limited, non-exclusive, revocable license to process, store, and transmit your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or your account.

5.3 AI-Generated Content

Outputs generated by our AI tools (listings, storyboards, copy) are provided as suggestions. You are responsible for reviewing and editing AI-generated content before publishing it on any marketplace. We do not guarantee the accuracy, completeness, or marketability of AI-generated content.

5.4 Content Responsibilities

You are solely responsible for your User Content. You represent and warrant that your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of third parties. You agree not to upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems.
• Use automated scripts, bots, or scrapers to access the Service.
• Resell, sublicense, or redistribute the Service or its outputs without our written consent.
• Interfere with or disrupt the Service, servers, or networks.
• Circumvent credit-based usage limits or attempt to exploit the credit system.
• Upload malicious code, viruses, or any harmful content.
• Impersonate another person or entity.

7. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is the intellectual property of AIPixer and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Third-Party Services

The Service integrates with third-party platforms (Amazon, Flipkart, Meesho) for resizing specifications and listing formats. Your use of these platforms is governed by their respective terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIPixer SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability to you shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless AIPixer, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. We may delete your account and data after a reasonable notice period. You may terminate your account at any time by contacting us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIPixer regarding the Service and supersede all prior agreements and understandings, whether written or oral.
